Terms
The terms that apply when you buy a programme or membership from me, and when you use this website.
DRAFT for legal review: this page has not been checked by a solicitor and may change.
1. Who I am
These terms apply to everything you buy from Lean Horizon Online. I am John, trading as Lean Horizon Online. [JOHN TO CONFIRM: legal name, trading status and a contact address.] You can contact me at hello@leanhorizononline.com.
By paying for a programme or membership you agree to these terms. Please read them first.
2. What I sell
Programmes: Kickstart (6 weeks), Transformation (8 weeks) and Elite (12 weeks), each in three levels (Beginner, Intermediate and Advanced) and two options.
Standard is a plan built for your level, delivered digitally to your email, with tracking. Premium is Standard plus a weekly check-in with me, where I review your progress and adjust your plan.
Lean for Life is a monthly membership for after a programme, at £35.99 a month, with no check-ins.
The plans are weights-based fat loss plans built on push, pull and legs. They are for adults in the UK. [JOHN TO CONFIRM: minimum age, for example 18.]
3. Prices and payment
Prices are in pounds sterling and are shown on the pricing and start pages. [JOHN TO CONFIRM: whether prices include VAT.]
You pay by card. Payments are processed by Stripe. I do not see or store your card details. A programme is paid for when you order. Lean for Life is billed monthly, in advance, on the same date each month until you cancel.
4. After you pay
After you pay, you complete a short health questionnaire. I then build your plan for your level and deliver it to you. [JOHN TO CONFIRM: how soon your plan is delivered after you complete the questionnaire.]
If you choose Premium, your weekly check-ins with me begin during your programme.
5. Your 14-day right to cancel
If you buy from me online, you have the right to cancel within 14 days, without giving a reason. The 14 days start the day after you place your order.
To cancel, tell me clearly in writing, for example by emailing hello@leanhorizononline.com. If you cancel within the 14 days and I have not started, I will refund you in full within 14 days of hearing from you, to the card you paid with.
6. If you ask me to start straight away
Your plan starts straight away, so at checkout you will be asked to confirm that you want me to begin within the 14 days, and that you understand how this affects your right to cancel. This is explained below.
If you ask me to start and then cancel within the 14 days, you must pay me a proportionate amount for what I have provided up to the time you told me you were cancelling. I will refund the rest. The amount depends on how much of the programme I have provided, for example whether your plan has been delivered and how many check-ins have taken place.
If I have fully provided the service within the 14 days, at your express request and with your acknowledgement that you lose your right to cancel once it is complete, you can no longer cancel. The same applies to digital content, such as your plan, once I have started to supply it with your agreement and your acknowledgement that you lose your right to cancel.
[JOHN TO CONFIRM with legal advice: how the proportionate amount is worked out for each programme, and the exact wording shown at checkout.]
7. Refunds
Outside your 14-day right to cancel, I do not usually refund a programme you have chosen to stop. This does not affect your legal rights. For example, if I do not provide the service with reasonable care and skill, you may be entitled to a repeat of the service or a refund. [JOHN TO CONFIRM: any goodwill refund policy.]
Refunds are made to the card you paid with.
8. Lean for Life
Lean for Life is billed monthly in advance. You can cancel at any time. Cancellation takes effect from your next billing date, so you will not be charged again after that. [JOHN TO CONFIRM: how to cancel, for example by emailing me or through Stripe.]
I do not refund the part of a month you have already paid for, unless the law says I must. Your 14-day right to cancel applies to your first payment as described in sections 5 and 6. [JOHN TO CONFIRM: how far in advance you will tell customers about any price change.]
9. Health and safety
Lean Horizon Online offers general fitness coaching. It is not medical advice. Speak to your GP before starting a new programme, especially if you have a health condition or injury, are pregnant, or have any concerns.
You must answer the health questionnaire honestly and tell me if anything changes. Stop training and get medical advice if something does not feel right. Exercise carries some risk, and you train at your own risk. Nothing in these terms limits any liability that the law does not allow me to limit.
10. No guaranteed results
Everyone is different. I cannot guarantee any particular result, and nothing on this site or in a plan is a promise of results.
11. Using your plan
Your plan is for your own personal use. Please do not share it, copy it or resell it.
12. My responsibility to you
I will provide the service with reasonable care and skill. I do not exclude or limit liability for death or personal injury caused by my negligence, for fraud, or for anything else the law does not allow me to exclude or limit. Your legal rights as a consumer are not affected by these terms.
Apart from that, I am not responsible for losses that were not a foreseeable result of me breaking these terms.
13. Complaints
If something is wrong, please email hello@leanhorizononline.com and I will do my best to put it right. [JOHN TO CONFIRM: any complaints process or alternative dispute resolution provider you want to name.]
14. Your data
How I use your personal data, including your health information, is explained in the privacy notice.
15. Changes and governing law
I may update these terms. The version in force when you order is the one that applies to your order.
These terms are governed by the law of England and Wales. [JOHN TO CONFIRM: jurisdiction, if you are based in Scotland or Northern Ireland.] If you live elsewhere in the UK, you can also bring a claim in the courts where you live.
